It also cites some of the movements taking place in terms of the regulatory posture on these products at the state level.<\/p>\n<p>\u201cHEI\/HEA providers maintain that these instruments are not loans,\u201d the report explained. \u201cHowever, some states have recently passed legislation to regulate these instruments, and require HEI\/HEA originators to hold mortgage lender licenses.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-product-criteria\">Product criteria<\/h2>\n<p>Fitch acknowledged the potential consumer benefits of these products. These include lower borrowing costs, no principal and interest payments, and no interest accrual over the life of the product. But the firm also said there are unique risks associated with them, including \u201climited performance history driven by the limited number of securitizations and issuers.\u201d<\/p>\n<p>There is also regulatory risk, Fitch said, particularly if HEI products are reclassified as a \u201cstandard mortgage loan.\u201d This could result in <a href=\"https:\/\/www.housingwire.com\/tag\/compliance\/\">compliance<\/a> violations, particularly if providers of these products do not maintain required licenses under legal and regulatory guidance that the mortgage industry must follow.<\/p>\n<p>Additional risks include \u201ccredit risk layering\u201d stemming from weak client credit profiles that may not have been accounted for in the <a href=\"https:\/\/www.housingwire.com\/tag\/underwriting\/\">underwriting<\/a> process, the report explained.<\/p>\n<p>The arrival of the report comes on the heels of accelerating scrutiny of the home equity investment landscape. Some of this is tied to legal definitions and regulations that govern reverse mortgages.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-recent-reverse-mortgage-comparisons\">Recent reverse mortgage comparisons<\/h2>\n<p>In <a href=\"https:\/\/www.housingwire.com\/tag\/washington\/\" target=\"_blank\" rel=\"noreferrer noopener\">Washington<\/a> state, a <a href=\"https:\/\/www.housingwire.com\/articles\/union-argues-in-court-that-equity-sharing-agreement-is-not-reverse-mortgage\/\" target=\"_blank\" rel=\"noreferrer noopener\">legal case<\/a> is playing out in the <strong>U.S. Court of Appeals for the Ninth Circuit<\/strong>. It features plaintiffs who argue that these products are actually reverse mortgages, at least under state law.<\/p>\n<p>The company defending itself in that suit, <a href=\"https:\/\/www.housingwire.com\/company\/unison\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Unison<\/strong><\/a>, maintains that there are several distinctions between its offerings and reverse mortgages. It pointed out in a hearing that the state Legislature does not include HEI products under its definitions for what constitutes a reverse mortgage.<\/p>\n<p>In January, the <a href=\"https:\/\/www.housingwire.com\/tag\/cfpb\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Consumer Financial Protection Bureau<\/strong><\/a> (CFPB) \u2014 at that point still under the leadership of Rohit Chopra \u2014 published an \u201cissue spotlight\u201d to highlight the <a href=\"https:\/\/www.housingwire.com\/articles\/cfpb-warns-consumers-home-equity-contracts-reverse-mortgage-features\/\" target=\"_blank\" rel=\"noreferrer noopener\">potential risks of HEIs for consumers<\/a>. One of these risks is that the products operate outside of the regulatory purview of other home-equity tapping products, including the <a href=\"https:\/\/www.housingwire.com\/tag\/fha\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Federal Housing Administration<\/strong><\/a> (FHA)-sponsored Home Equity Conversion Mortgage (<a href=\"https:\/\/www.housingwire.com\/tag\/hecm\/\" target=\"_blank\" rel=\"noreferrer noopener\">HECM<\/a>) program.<\/p>\n<p>The bureau also filed an amicus brief in a case involving a home equity contract company. It took the position that a home equity contract counts as a residential mortgage and corroborated that perspective with comparisons to reverse mortgages.<\/p>\n<p>\u201cMany homeowners expect that when they put their house on the line in exchange for getting money, they will also get certain protections. But right now, some home equity contract companies say that they don\u2019t have to follow those laws,\u201d the bureau said when detailing its HEI activity. \u201cThe CFPB filed a brief in a court case where one home equity contract company said exactly that.\u201d<\/p>\n<p>Additionally, the <a href=\"https:\/\/www.housingwire.com\/tag\/oregon\/\" target=\"_blank\" rel=\"noreferrer noopener\">Oregon<\/a> legislature debated a bill that specifically targeted reverse mortgages by name. But it was later determined in a hearing that the <a href=\"https:\/\/www.housingwire.com\/articles\/oregon-reverse-mortgage-bill-that-could-halt-proprietary-business-may-be-amended\/\" target=\"_blank\" rel=\"noreferrer noopener\">intended regulatory target<\/a> was the home equity investment industry, not the reverse mortgage business.<\/p>\n<p>\u201cIt is important to be able to parse the difference between a reverse mortgage loan that is [backed by] FHA, a loan that is governed by HUD regulations [and which is] very tightly regulated. Equity sharing agreements [are totally different],\u201d said David Ellison, a Portland-area reverse mortgage originator with <a href=\"https:\/\/www.housingwire.com\/company\/longbridge-financial\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Longbridge Financial<\/strong><\/a> who provided testimony about the measure in a committee hearing last month.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-time-tested-hecm\">Time-tested HECM<\/h2>\n<p>More recently, <a href=\"https:\/\/www.housingwire.com\/tag\/massachusetts\/\" target=\"_blank\" rel=\"noreferrer noopener\">Massachusetts<\/a> Attorney General Andrea Joy Campbell <a href=\"https:\/\/www.housingwire.com\/articles\/massachusetts-ag-sues-hometap-over-illegal-reverse-mortgage\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed a lawsuit<\/a> against HEI provider <a href=\"https:\/\/www.housingwire.com\/tag\/hometap\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Hometap<\/strong><\/a>. In part, Campbell alleges that Hometap\u2019s product offerings constitute \u201cillegal reverse mortgages that fail to comply with state consumer protection laws.\u201d <\/p>\n<p>Hometap denied the allegations in a statement to <strong>HousingWire<\/strong>\u2018s Reverse Mortgage Daily (RMD) and is pursuing its legal defense in the matter.<\/p>\n<p>\u201cWe have pursued every possible avenue to engage in constructive dialogue with the Massachusetts attorney general\u2019s office,\u201d the company said. \u201cUnfortunately, those efforts have not been reciprocated, and we believe they are pursuing an unfounded lawsuit predicated on meritless claims.\u201d<\/p>\n<p>But some members of the reverse mortgage industry have long held that such products are simply not time-tested enough in comparison to something like the HECM loan product. They have raised similar concerns to this week\u2019s Fitch report about overall product longevity.<\/p>\n<p>\u201cWe now have 30 years of product testing and market revision to get to what is, today, an exceptional and unique financial product when used in the right application,\u201d Scott Harmes of <strong>C2 Reverse<\/strong> told <a href=\"https:\/\/www.housingwire.com\/articles\/rmd-report-alternative-equity-tools-could-bode-well-for-reverse-mortgage-industry\/\" target=\"_blank\" rel=\"noreferrer noopener\">RMD in 2019<\/a>. <\/p>\n<p>\u201cWe\u2019ve seen equity conversion methods come and go, because they\u2019re not market-proven or market refined long-term.
