The federal judge overseeing the case brought by reverse mortgage lender Longbridge Financial<\/strong><\/a> against market leader Mutual of Omaha Mortgage<\/strong><\/a> over allegedly deceptive advertising practices has ruled that some of Longbridge\u2019s claims warrant limited injunctive relief, finding that \u201cthe law and facts clearly favor some of Longbridge\u2019s claims.\u201d<\/p>\n

The order was handed down Tuesday by Judge Dana M. Sabraw, an appointee of President George W. Bush, in the U.S. District Court for the Southern District of California<\/strong>. Longbridge filed the suit last fall<\/a>, alleging that a series of advertising websites are deceptive, and did not clearly specify to consumers that Mutual of Omaha had control over one of them.<\/p>\n

Dispute and ruling<\/h2>\n

Over the past several months, Longbridge and Mutual of Omaha have been filing information with the court, making and\/or responding to various claims by the other party. <\/p>\n

But it wasn\u2019t until this week that Sabraw weighed in to assess Longbridge\u2019s request for a preliminary injunction<\/a>. It seeks to take down material it considers deceptive and misleading from websites that it claims unfairly steer reverse mortgage business toward Mutual.<\/p>\n

While some particulars of Longbridge\u2019s argument were rejected by the judge, he ultimately decided to restrict future statements which may imply that Longbridge is not licensed to offer reverse mortgages in states that it is.<\/p>\n

Sabraw also ruled that Mutual may not \u201csimultaneously advertise to consumers on sponsored Google<\/strong>-search links that they provide information relating to \u2018Top 3\u2019 reverse mortgage providers\u201d without listing three independent lenders.<\/p>\n

One of the contentions made by Longbridge in the suit is that Mutual of Omaha was presenting Retirement Funding Solutions<\/strong> (RFS) as a separate entity in its rankings of \u201ctop\u201d reverse mortgage lenders on the two websites at issue \u2014 Review Counsel<\/strong> and Advisory Institute<\/strong>. RFS was the brand that the reverse mortgage arm of Mutual of Omaha previously operated under.<\/p>\n

In 2019, this division transitioned primarily<\/a> to the Mutual of Omaha name, but an RFS website is maintained by the company, the original court complaint said.<\/p>\n

\u201cReview Counsel and Advisory\u2019s prior Google ads promising information about \u2018Top 3\u2019 reverse mortgage providers are problematic because those ads redirected consumers to landing pages that highlighted Mutual of Omaha and RFS \u2014 which the parties agree are the same company \u2014 as two of the three \u2018top\u2019 providers,\u201d Sabraw wrote. <\/p>\n

\u201cThus, the law and facts clearly favor Longbridge\u2019s claim that these statements were literally false on their face.\u201d<\/p>\n

The judge added that Longbridge \u201chas established that the law and facts clearly favor its claim that Review Counsel and Advisory\u2019s spotlighting and recommending of Mutual of Omaha and RFS as two separate reverse mortgage providers was literally false by necessary implication.\u201d<\/p>\n

The judge ruled that Longbridge has sufficiently \u201ccarried its burden to show that the other past statements, while not literally false, would likely mislead or confuse consumers.\u201d He added that previous disclosures on Review Counsel\u2019s website describing it as \u201caffiliated\u201d with Mutual of Omaha \u201cobfuscated Mutual of Omaha\u2019s actual control and ownership of Review Counsel.\u201d<\/p>\n

Disclosures and relationships<\/h2>\n

Advisory Institute is not owned by Mutual, but it was founded in January 2024 by \u201ca former general counsel of Mutual of Omaha, and is wholly owned by him,\u201d meaning that the lender \u201cis Advisory\u2019s only advertising partner,\u201d according to the judge.<\/p>\n

Its disclosures specified that it receives advertising compensation \u201cfrom certain partners\u201d which \u201cmay influence the presence and positioning of companies\u201d on the website.<\/p>\n

But \u201cat no point did Advisory disclose that Mutual of Omaha paid it to advertise on Advisory\u2019s website,\u201d the judge said. Advisory clarified its relationship to Mutual in updates made to its website in January.<\/p>\n

\u201cAdvisory\u2019s long-form disclosure page ultimately provides\u201d information about such a relationship, the judge said. But Longbridge sufficiently demonstrated that Advisory\u2019s September 2024 disclosures \u201cwere misleading and confusing to consumers,\u201d particularly since the lender is the only advertising partner with which the site engages in business.<\/p>\n

Longbridge also argued in its filings that the presence of the \u201c.org\u201d extension on the sites\u2019 web addresses could give the impression that the sites are nonprofit entities. The judge rejected that argument.<\/p>\n

Mutual of Omaha and the other defendants\u2019 \u201ccurrent disclosures likely counteract\u201d such an argument, the judge said. \u201cAccordingly, the Court declines to require Defendants to remove their webpages on this ground.\u201d<\/p>\n

But the order restricts the defendants from \u201cadvertis[ing] RFS on their websites as if RFS were an independent reverse mortgage provider originating its own loans.\u201d <\/p>\n

It also calls for Review Counsel to maintain what is currently a prominent banner on its homepage<\/a> stating it is \u201cowned and operated by Mutual of Omaha Mortgage.\u201d Lastly, Advisory may \u201cnot diminish\u201d the clarity or visibility of disclosures as they appeared in January.<\/p>\n

Company responses<\/h2>\n

HousingWire<\/strong>\u2019s Reverse Mortgage Daily (RMD) reached out multiple times to representatives of Mutual of Omaha prior to the publication of this story, but received neither a reply nor an acknowledgement of its requests for comment.<\/p>\n

Trevor Chapman, a spokesperson for Longbridge, provided RMD with a statement.<\/p>\n

\u201cWe are pleased the court recognized the merits of our claims and has taken steps to address the misleading conduct we identified,\u201d Chapman said.<\/p>\n

\u201cWhile we believe most participants operate with integrity, this preliminary injunction is a positive step toward protecting consumers from deceptive marketing practices and helping to ensure fair competition in the reverse mortgage marketplace. We\u2019re confident the facts will continue to support our case as this process moves forward.\u201d<\/p>\n
