So places outside of what we call active management areas were essentially unregulated.\u201d<\/p>\n<p>Even within AMAs, the law draws important distinctions between homes built within the boundaries of a designated municipal water provider and those built just beyond.<\/p>\n<p>Cities like <a href=\"https:\/\/www.housingwire.com\/tag\/phoenix\/\">Phoenix <\/a>must prove every 15 years that they can meet water demands for the next century \u2014 but developers building just outside those boundaries only need to prove it once, Maguire said. <\/p>\n<p>\u201cWhen you\u2019re talking about a developer who builds outside of a designated service area and gets a certificate of assured water supply, it\u2019s a snapshot,\u201d she said. \u201cAt that point in time, they had a 100-year assured water supply. Going forward, they don\u2019t have to have further proof. <\/p>\n<p>\u201cThey\u2019re done. They sell their homes and they\u2019re on their way to develop another subdivision.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-assured-supply-requirements-under-fire\">Assured supply requirements under fire<\/h2>\n<p>That 100-year rule \u2014 widely considered one of the most rigorous groundwater standards in the nation \u2014 is now at the heart of a legal fight.<\/p>\n<p>In 2023, the <a href=\"https:\/\/www.housingwire.com\/tag\/arizona\/\">Arizona<\/a> Department of Water Resources released a new groundwater model showing that <a href=\"https:\/\/www.housingwire.com\/articles\/realtor-com-study-federal-land-sales-offer-limited-housing-relief\/\">key growth communities<\/a> like Buckeye and Queen Creek no longer have enough groundwater to support new subdivisions over the long term.<\/p>\n<p>The model effectively halted new, for-sale housing outside of designated municipal providers in those areas.<\/p>\n<p>Spencer Kamps, vice president of legislative affairs for the <strong>Home Builders Association of Central Arizona<\/strong>, sharply criticized the model.<\/p>\n<p>\u201cWe think it\u2019s significantly flawed, inaccurate and has been misrepresented,\u201d said Kamps. \u201cThe consequences are that you can no longer grow any homes for sale outside designated providers. And the two biggest communities impacted by that are Buckeye and Queen Creek, the fastest growing communities in the valley, and [the] most affordable housing market in the valley all have been shut down.\u201d<\/p>\n<p>The builders\u2019 association filed a lawsuit earlier this year challenging the department\u2019s findings and accusing the state of singling out the for-sale housing market while allowing other sectors \u2014 such as industry and <a href=\"https:\/\/www.housingwire.com\/tag\/rental-properties\/\">rental<\/a> housing \u2014 to continue using groundwater with fewer constraints.<\/p>\n<p>\u201cThere are eight to nine projects that are currently stalled because of the groundwater model,\u201d Kamps said. \u201cAnd due to that, there\u2019s been in excess of $3 billion invested in the ground solely for houses. <\/p>\n<p>\u201cWe have plans for over 200,000 lots in northern Buckeye and that\u2019s been challenging, to say the least.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-differing-views\">Differing views<\/h2>\n<p>Maguire argues that the 100-year requirement is a cornerstone of water sustainability and consumer protection.<\/p>\n<p>\u201cI think that the 100-year assured water supply is really important consumer protection,\u201d she said. \u201cFrankly, it could be longer \u2014 100 years goes by pretty quickly.\u201d<\/p>\n<p>She also highlighted the difference between renewable water \u2014 such as surface water from the Colorado River \u2014 and groundwater, which can take centuries to recharge.<\/p>\n<p>\u201cYou pump that water out, it isn\u2019t immediately replenished,\u201d she said. \u201cIt takes hundreds of years, millennia, to restore an aquifer.\u201d<\/p>\n<p>Kamps countered that the law now penalizes industries that replenish aquifers through programs like the <strong>Central Arizona Groundwater Replenishment District<\/strong>.<\/p>\n<p>\u201cIf you replenish your groundwater, you can\u2019t grow. But if you mine groundwater \u2014 which is what commercial and industrial users do \u2014 that\u2019s okay,\u201d he said. \u201cIt\u2019s upside down.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-no-single-for-sale-home\">\u201cNo single for-sale home\u201d<\/h2>\n<p>The dispute has put a spotlight on one of the fastest-growing regions in the country.<\/p>\n<p>Communities like Buckeye and Queen Creek have become magnets for families priced out of central Phoenix \u2014 but many of those areas fall outside designated water provider zones.<\/p>\n<p>\u201cRight now, you can build data centers and chip factories as far as the eye can see, but you can\u2019t build one single for-sale home,\u201d Kamps said. \u201cThat\u2019s not protecting the aquifer \u2014 that\u2019s shutting down housing.\u201d<\/p>\n<p>He pointed to large industrial users like the <strong>Taiwan Semiconductor Manufacturing Company<\/strong> plant in Phoenix, which he said uses between 30,000 and 35,000 acre-feet of water annually \u2014 equivalent to more than 100,000 homes.<\/p>\n<p>\u201cHousing uses far less water than agriculture and actually reduces ag pumping,\u201d Kamps said. \u201cWe need to be at the table \u2014 because right now, the system is broken.\u201d<\/p>\n<p>Maguire said occasional confusion over water availability is exacerbated by <a href=\"https:\/\/www.housingwire.com\/tag\/homebuyers\/\">homebuyers<\/a> coming to the state who may not understand Arizona\u2019s complex system of water rights and regulation.<\/p>\n<p>\u201cIf there\u2019s a misconception, it would only be to the extent that you\u2019re not aware that there is some risk associated with the long term availability of groundwater supplies across the state,\u201d she said. \u201cThat\u2019s why we adopted the various regulatory programs to try to put in place more protection.<\/p>\n<p>\u201cCertainly if you have Colorado River water, that\u2019s a better source of supply.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-science-lawsuits-political-pressure\">Science, lawsuits, political pressure<\/h2>\n<p>The builders\u2019 lawsuit also challenges the state\u2019s use of hydrologic modeling to determine water availability. <\/p>\n<p>Developers commissioned an independent environmental firm to produce their own groundwater model for the Phoenix basin, which, according to records, offered significantly more optimistic projections for the region\u2019s aquifers.<\/p>\n<p> Kamps said it\u2019s common for developers to submit independent hydrology reports \u2014 sometimes at the state\u2019s request.<\/p>\n<p>\u201cIt\u2019s very common for the Department to say, \u2018Hey, we need more hydrology at your site.\u2019 We go out, examine X, Y and Z, and provide that information,\u201d he said. \u201cNo different than what\u2019s being done here.\u201d<\/p>\n<p>But Maguire suggested that technical arguments may mask deeper legal and political tensions.<\/p>\n<p>\u201cThere are places where we\u2019re running low on groundwater,\u201d she said. \u201cIn fact, we\u2019re hitting the legal boundaries for access to groundwater, and they are denying applications for a certificate of assured water supply. That creates political pressure to revisit that regulatory program.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-eyes-on-the-colorado-river\">Eyes on the Colorado River<\/h2>\n<p>Looking ahead, both Maguire and Kamps said that Arizona\u2019s role in regional negotiations over the Colorado River will be critical. <\/p>\n<p>New water-sharing guidelines are being developed to replace the current framework, which expires in 2026.<\/p>\n<p>\u201cThe states and the feds are sitting down and trying to come up with a new paradigm for how to operate,\u201d said Maguire, \u201cprimarily Lake Powell and Glen Canyon Dam, and Lake Mead and Hoover Dam. How much water is released when it\u2019s released? What are the conditions for releases?\u201d<\/p>\n<p>She noted that 22 Native American tribes in Arizona \u2014 many of whom rely on Colorado River water \u2014 are also part of the negotiations.<\/p>\n<p>\u201cYou\u2019ve got a lot of folks watching and trying to ensure that they have a secure water supply post-2026,\u201d Maguire said.<\/p>\n<p>Kamps said the homebuilding industry should have a voice in those discussions as well.<\/p>\n<p>\u201cWell, guess what they\u2019re doing with the Colorado River,\u201d he said. \u201cThey\u2019re renegotiating so nobody can offer up any water to our builders to finish these projects. It\u2019s not because of any ill will. It\u2019s just like they don\u2019t know if they\u2019re going to have the water next year, so the consequence is there is no water available for us to move these projects forward.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-a-statewide-reckoning\">A statewide reckoning<\/h2>\n<p>The debate over groundwater in Arizona is more than a clash between developers and regulators \u2014 it reflects a broader reckoning over how the state will grow in an era of rising temperatures and tightening water supplies.<\/p>\n<p>Despite the complexity of the issues, Maguire sees growing public understanding as a hopeful sign.<\/p>\n<p>\u201cThe press is doing a pretty good job of covering these water issues,\u201d she said. \u201cThey\u2019re very complicated, but I think overall, the public\u2019s pretty well educated and certainly has the resources available to understand what the political leaders and the business leaders are trying to do to ensure that there\u2019s a secure water supply.\u201d<\/p>\n<p>But as legal battles unfold and reservoirs dwindle, Arizona faces difficult decisions about what \u2014 and whom \u2014 its water laws are really built to protect.<\/p>\n<p>\u201cWhat (regulators) are saying, and what the deficiency letters have said that we\u2019ve received is, \u2018You may actually have 100 years worth of water at the location of your site, but a well may go dry in Queen Creek, and you need to resolve that,&#8217;\u201d Kamps said. \u201cThat is a new policy position out of the department that\u2019s never been done before, and that\u2019s one of the issues we\u2019re we\u2019re discussing in court.\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>As Arizona grapples with rapid growth and a changing climate, long-standing groundwater regulations are being tested in courtrooms, boardrooms and booming desert suburbs.
