A magistrate judge in U.S. District Court in West Palm Beach, Florida, is recommending that the court dismiss the Zea antitrust lawsuit filed against the \u041d\u0430\u0446\u0438\u043e\u043d\u0430\u043b\u044c\u043d\u0430\u044f \u0430\u0441\u0441\u043e\u0446\u0438\u0430\u0446\u0438\u044f \u0440\u0438\u044d\u043b\u0442\u043e\u0440\u043e\u0432<\/strong> (NAR) and several local Realtor associations and MLSs.\u00a0<\/p>\n

Filed in August<\/a>, the lawsuit claims that the defendants engaged in a \u201ccoordinated scheme\u201d to restrict consumer choice and maintain elevated prices, harming his \u0431\u0440\u043e\u043a\u0435\u0440\u0441\u043a\u0430\u044f \u0434\u0435\u044f\u0442\u0435\u043b\u044c\u043d\u043e\u0441\u0442\u044c<\/a> \u043c\u043e\u0434\u0435\u043b\u044c.<\/p>\n

Plaintiff Jorge Zea runs www.snapflatfee.com<\/strong>, a brokerage that charges sellers a listing fee in exchange for limited services. Zea\u2019s firm syndicates listings data to the \u041c\u041b\u0421<\/a> data feeds and forwards all buyer leads \u201cregardless of their origin\u201d directly to the seller.<\/p>\n

According to Zea, buyer\u2019s agents associated with the defendants \u043d\u0430\u043f\u0440\u0430\u0432\u043b\u044f\u0442\u044c \u043a\u043b\u0438\u0435\u043d\u0442\u043e\u0432<\/a> away from properties that offer a reduced or nonexistent buyer\u2019s agent commission<\/a>. In his complaint, he argues that this steering is the result of the NAR and the other defendants not enforcing their own rules.\u00a0<\/p>\n

The rules in question relate to the mandatory display of a listing broker\u2019s contact information on the listing page in an IDX display; the commission lawsuit mandate for \u0441\u043e\u0433\u043b\u0430\u0448\u0435\u043d\u0438\u044f \u0441 \u043f\u043e\u043a\u0443\u043f\u0430\u0442\u0435\u043b\u0435\u043c<\/a>; and the prohibition of MLS platforms from allowing users to search or filter results by the name of the listing broker or agent, or by the amount of compensation offered.<\/p>\n

By allegedly refusing to enforce these rules, Zea claims that the defendants<\/a> have competitively disadvantaged his discount-brokerage business.<\/p>\n

Complaint is \u201cdeficiently pled\u201d<\/h2>\n

In a report filed on Tuesday, Magistrate Judge William Matthewman calls the complaint \u201cdeficiently pled\u201d and recommends that the court grant the defendants\u2019 motion to dismiss the lawsuit with prejudice, which would allow Zea to refile his complaint against these defendants in the future. However, Magistrate Judge Matthewman said that the lawsuit should be dismissed without prejudice because the plaintiff is representing himself and as a result that is would \u201cnot necessarily be futile\u201d for Zea to file an amended complaint.\u00a0<\/p>\n

The judge also notes that Zea must proceed in \u201cgood faith\u201d if he wishes to do so, as the report recommends that the court admonish Zea for using fake legal arguments and citations in his filings.\u00a0<\/p>\n

\u201cShould this conduct continue in any manner, the Court will consider the imposition of much more serious sanctions upon Plaintiff,\u201d the magistrate judge writes.\u00a0<\/p>\n

The Judge\u2019s report notes that many of the cases Zea cites in his filings do not exist and are the results of AI hallucinated law. While Zea has apologized to the court for this, he only acknowledged one citation.\u00a0<\/p>\n

\u201cThe hallucination issue is more prevalent than Plaintiff admits. Therefore, while Plaintiff has conceded that he made a mistake, and sanctions are likely not appropriate, the Court simply cannot trust the legal arguments of Plaintiff,\u201d Magistrate Judge Matthewman wrote. \u201cAnd, Plaintiff is doing himself a great disfavor by relying on fake legal arguments, which further weaken his position.\u201d\u00a0<\/p>\n

Additionally, the judge also notes that in his filings Zea has also \u201cattempted to rewrite the law regarding Sherman Act claims in arguing that he is not required to plead a conspiracy, or even an agreement, and has supported his argument with law invented by AI.\u201d\u00a0<\/p>\n

Objections to the report are due by April 7. Zea did not previously object to other recommendations the judge made in this lawsuit.\u00a0<\/p>\n

Earlier this month Judge William Dimitrouleas, who is overseeing the lawsuit, \u0443\u0432\u043e\u043b\u0435\u043d<\/a> \u0410\u0441\u0441\u043e\u0446\u0438\u0430\u0446\u0438\u044f \u0440\u0438\u044d\u043b\u0442\u043e\u0440\u043e\u0432 \u041a\u043e\u043d\u043d\u0435\u043a\u0442\u0438\u043a\u0443\u0442\u0430<\/strong> (CT Realtors) and Connecticut-based \u0421\u043c\u0430\u0440\u0442 MLS<\/strong>, as well as Arizona-based \u0420\u0438\u044d\u043b\u0442\u043e\u0440\u044b \u043d\u0430 \u0437\u0430\u043f\u0430\u0434\u0435 \u0438 \u044e\u0433\u043e-\u0432\u043e\u0441\u0442\u043e\u043a\u0435 \u0434\u043e\u043b\u0438\u043d\u044b<\/strong> (WeSERV) upon the recommendation<\/a> of Magistrate Judge Matthewman.<\/p>\n
