{"id":62952,"date":"2026-05-07T03:08:29","date_gmt":"2026-05-07T01:08:29","guid":{"rendered":"https:\/\/housesmarketplace.trio-tv.com\/nar-says-policies-already-align-with-new-hud-stance-on-sharing-school-crime-data\/"},"modified":"2026-05-07T03:08:29","modified_gmt":"2026-05-07T01:08:29","slug":"nar-says-policies-already-align-with-new-hud-stance-on-sharing-school-crime-data","status":"publish","type":"post","link":"https:\/\/housesmarketplace.trio-tv.com\/ru\/nar-says-policies-already-align-with-new-hud-stance-on-sharing-school-crime-data\/","title":{"rendered":"NAR says policies already align with new HUD stance on sharing school, crime data"},"content":{"rendered":"<div>\n<p>The <strong>\u041d\u0430\u0446\u0438\u043e\u043d\u0430\u043b\u044c\u043d\u0430\u044f \u0430\u0441\u0441\u043e\u0446\u0438\u0430\u0446\u0438\u044f \u0440\u0438\u044d\u043b\u0442\u043e\u0440\u043e\u0432 <\/strong>(NAR) says its existing policies already align with new <a href=\"https:\/\/www.housingwire.com\/articles\/hud-says-realtors-can-discuss-crime-and-school-data\/\">federal guidance <\/a>allowing agents to discuss neighborhood crime rates and school quality without violating the Fair Housing Act\u2019s prohibition on racial steering. <\/p>\n<p>The <strong>\u0414\u0435\u043f\u0430\u0440\u0442\u0430\u043c\u0435\u043d\u0442 \u0436\u0438\u043b\u0438\u0449\u043d\u043e\u0433\u043e \u0441\u0442\u0440\u043e\u0438\u0442\u0435\u043b\u044c\u0441\u0442\u0432\u0430 \u0438 \u0433\u043e\u0440\u043e\u0434\u0441\u043a\u043e\u0433\u043e \u0440\u0430\u0437\u0432\u0438\u0442\u0438\u044f<\/strong> (HUD) announced the new guidance last week, reversing Biden-era policies that led many real estate firms to remove or restrict such information. <a href=\"https:\/\/www.hud.gov\/sites\/default\/files\/hudclips\/documents\/AS-Trainor%27s-DCL-on-Neighborhood-Crime-Data-and-School-Quality.pdf\">HUD\u2019s announcement <\/a>characterized past industry practices as restrictive \u2014 and accused NAR of imposing a \u201cprofessional gag order\u201d on members.<\/p>\n<p>In an emailed response to HousingWire, a NAR spokesperson disputed that framing. <\/p>\n<p>\u201cNAR has never prohibited these conversations between agents and prospective homebuyers,\u201d the spokesperson said. \u201cNAR\u2019s Code of Ethics, fair housing training and fair housing manuals explicitly allow members to discuss neighborhood information regarding crime and school data. For decades, NAR has emphasized that members share accurate, objective information, not opinions or hearsay. This is a risk management best practice.<\/p>\n<p>\u201cSome practitioners, misunderstanding the law or seeking to eliminate all risk, may have adopted the view, \u2018it\u2019s illegal to talk about it.\u2019 That has never been NAR\u2019s guidance.\u201d<\/p>\n<p>The NAR spokesperson added: \u201cNAR\u2019s current training and guidance generally align with HUD\u2019s position that agents can and should provide prospective buyers with the information they seek on neighborhood crime and school quality, provided the information comes from an accurate third-party resource and is not subjective opinion. We believe it will be helpful to underscore among our membership that the law and our existing guidance supports these practices.\u201d<\/p>\n<p>The association may provide more information on the topic, the spokesperson said. \u201cWe may supplement existing guidance and training materials to provide additional best practices on how agents may comply with the law while providing consumers with the information they seek.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-legal-backing-and-lingering-risk\">Legal backing \u2014 and lingering risk<\/h2>\n<p>Attorney Robert Butters \u2014 a former <a href=\"https:\/\/www.housingwire.com\/articles\/nar-wright-transparency-antitrust\/\">\u041d\u0410\u0420<\/a> deputy general counsel and antitrust trial attorney in the <strong>Federal Trade Commission\u2019s<\/strong> Bureau of Competition \u2014 said HUD\u2019s updated stance aligns with arguments he has made for years.<\/p>\n<p>\u201cThe assumption behind preventing that kind of information included minority home seekers being less concerned about crime statistics than majority home seekers, which I never found to be logical,\u201d he said. \u201cIt\u2019s the same thing with schools. Do you mean that minority home seekers don\u2019t care about the quality of the schools their children are going to attend? None of that made any sense to me.\u201d<\/p>\n<p>Butters said the prior reasoning required drawing tenuous inferences about how different groups interpret information \u2014 an approach he viewed as inconsistent with the <a href=\"https:\/\/www.housingwire.com\/articles\/hud-equal-access-rule\/\">\u0417\u0430\u043a\u043e\u043d \u043e \u0441\u043f\u0440\u0430\u0432\u0435\u0434\u043b\u0438\u0432\u043e\u043c \u0436\u0438\u043b\u0438\u0449\u043d\u043e\u043c \u043e\u0431\u0435\u0441\u043f\u0435\u0447\u0435\u043d\u0438\u0438<\/a>.<\/p>\n<p>At the same time, he cautioned that the new guidance does not eliminate legal exposure for <a href=\"https:\/\/www.housingwire.com\/articles\/agents-invisible-ai-search\/\">\u0430\u0433\u0435\u043d\u0442\u044b<\/a> or brokerages.<\/p>\n<p>\u201cThere\u2019s always a risk of being sued,\u201d Butters said. \u201cYou open the door of your establishment, you\u2019re taking on a degree of risk. The question is, what is your tolerance? I think the position will make it easier to defend the cases, if they come, and it may be a mitigating factor on potential plaintiffs for bringing the cases in the first place.<\/p>\n<p>\u201cThey\u2019re going to have to contend with the current HUD position on that, but you really can\u2019t eliminate down to zero risk.\u201d<\/p>\n<p>He added that HUD\u2019s interpretation, while influential, is not binding on courts \u2014 meaning judges and juries could still reach different conclusions.<\/p>\n<p>NAR said its position continues to emphasize a distinction between what is legally permissible and what is professionally advisable \u2014 particularly when it comes to subjective commentary.<\/p>\n<p>\u201cSubjective commentary is not automatic evidence of discriminatory intent,\u201d the spokesperson said. \u201cBut subjective commentary raises the risk that the agent will present biased information. Courts have held that statements about crime and schools, in some situations, can be deployed as \u2018code words\u2019 for race and evidence of discriminatory intent. That doesn\u2019t mean that every time an agent shares an opinion, it\u2019s discriminatory. <\/p>\n<p>\u201cNAR\u2019s risk-management guidance helps ensure members are providing accurate, unbiased information. It is not a declaration that entire categories of speech are illegal.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-state-laws-complicate-compliance\">State laws complicate compliance<\/h2>\n<p>Butters said agents must also consider stricter state and local standards \u2014 which can broaden liability even as federal guidance becomes more permissive.<\/p>\n<p>\u201cEvery state, indeed, and in many cases, localities, counties and municipalities, also have fair housing statutes, and many of those are broader in scope,\u201d he said. \u201cThey extend protection, for example, to sexual preference and other protected classifications that go beyond what\u2019s in the federal Fair Housing Act.\u201d<\/p>\n<p>Differences in judicial interpretation across jurisdictions could further complicate compliance decisions, even with HUD\u2019s updated position, Butters added. <\/p>\n<p>Still, he said the new federal guidance provides meaningful support for agents navigating those risks.<\/p>\n<p>\u201cThis HUD pronouncement is is going to be helpful, even if you\u2019re being sued under a state statute that that may be interpreted more broadly,\u201d Butters said. \u201cIt\u2019s better to be able to cite to this than not being able to cite to it, even if you\u2019re in a state or municipal forum.\u201d<\/p>\n<p>As brokerages, listing platforms and agents reassess policies, the combined message from NAR and legal experts is nuanced \u2014 more flexibility, but not less responsibility.<\/p>\n<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>The National Association of Realtors (NAR) says its existing policies already align with new federal guidance allowing agents to discuss neighborhood crime rates and school quality without violating the Fair Housing Act\u2019s prohibition on racial steering.
